HIGHLAND PARK – A Highland Park resident was arrested and charged with Aggravated Battery, Unlawful Restraint and Kidnapping in association with an incident that was reported to police early on Sunday, August 13.
At 3:23 a.m. that day, a woman reported to police that she had just been assaulted in the 2300 block of Green Bay Road in Highland Park. Police later determined that the alleged incident was not a random act but that the accused and accuser knew each other, according to a press release from the Highland Park Police Department.
The release also stated that the woman said she was walking on Green Bay when the accused approached her and made sexual advances, including grabbing her from behind and pulling her toward the street. A driver of a passing car, having witnessed the incident taking place, began honking and flashing bright lights. The woman reported that she escaped, the suspect fled on foot, and she then used her cell phone to call 911.
According to the HPPD news release, officers immediately responded to the area, located the woman, obtained a description of the suspect and began searching for him. The woman was not injured and declined medical treatment. A short time after the incident was reported the accused was taken into custody by Highland Park Police. Investigators determined that the two knew each other and that the attack was not a random act.
The suspect was identified as Damien Toledo, 45, of the 2400 Block of Trillium Avenue, Highland Park. He ws transported to Bond Court on Monday, August. 14.
The Lake County States Attorney’s Office approved the following charges: Aggravated Battery on a Public Way, a Class 3 Felony; Unlawful Restraint, a Class 4 Felony; Kidnapping, a Class 2 Felony.
